1. Acceptance of Terms
By accessing or using the Safe4r Workplace Solutions™ website, platform, or any services offered by Safe4r Workplace Solutions, Health Karma Inc., or affiliated partners (collectively, "Safe4r," "we," "our," or "us"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our services.
2. Description of Services
Safe4r Workplace Solutions™ provides workplace violence prevention services, software, training, and consultation through an integrated platform combining:
- Noble — SCOUT Threat Recognition Training — behavioral threat identification training programs
- Safe4r Geo-Fencing and Mass Notification Technology — location-based emergency alert and notification services
- Health Karma Workplace Concern Line — behavioral health support, clinical consultation, and workplace incident reporting services
- WVPP Plan Builder, Risk Assessment, Incident Reporting, Anti-Retaliation, and Analytics modules
Services are provided pursuant to separate service agreements, statements of work, or subscription agreements entered into between Safe4r and client organizations.
3. Use of the Platform
Authorized users of the Safe4r platform agree to use the services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the platform in any manner that violates applicable federal, state, or local laws or regulations
- Attempt to gain unauthorized access to any portion of the platform or its related systems
- Transmit any content that is unlawful, defamatory, threatening, or otherwise objectionable
- Use the platform to interfere with or disrupt the integrity or performance of the services
- Reverse engineer, decompile, or disassemble any aspect of the platform
- Share login credentials or allow unauthorized individuals to access the platform
4. User Accounts and Security
Organizations accessing the Safe4r platform are responsible for maintaining the confidentiality of all account credentials. You agree to notify Safe4r immediately of any unauthorized use of your account. Safe4r will not be liable for any loss or damage arising from your failure to maintain account security.
5. Confidentiality and Data Privacy
Safe4r is committed to protecting the privacy and confidentiality of all data submitted through the platform. Anonymous reporting channels maintain reporter confidentiality in accordance with applicable law. All data is encrypted in transit and at rest using industry-standard security protocols. 6. Health Karma Concern Line — Clinical Services
The Health Karma Workplace Concern Line provides access to master's-level behavioral health clinicians. Important limitations:
- The Concern Line does not constitute an emergency service. Individuals in immediate danger should contact 911.
- Clinician consultations are supportive in nature and do not constitute a formal therapeutic relationship unless separately established
- Information shared on the Concern Line is handled in accordance with applicable confidentiality laws including HIPAA where applicable
- The Concern Line is not a substitute for emergency mental health services
7. Compliance Information Disclaimer
Information provided on this website regarding workplace violence prevention laws, regulations, and compliance requirements is provided for general informational purposes only and does not constitute legal advice. Laws and regulations change frequently. Organizations should consult qualified legal counsel regarding their specific compliance obligations. Safe4r makes reasonable efforts to keep compliance information current but does not guarantee the accuracy or completeness of regulatory information provided.
8. Intellectual Property
All content on the Safe4r website and platform — including text, graphics, logos, training materials, software, and documentation — is the property of Safe4r Workplace Solutions, Health Karma Inc., or its respective partners and is protected by applicable intellectual property laws. Unauthorized reproduction, distribution, or use of any platform content is strictly prohibited.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAFE4R WORKPLACE SOLUTIONS AND ITS PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. SAFE4R'S TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU FOR THE SERVICES IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
Safe4r does not warrant that its services will prevent all workplace violence incidents. The platform provides tools, training, and support to reduce risk and improve organizational preparedness — outcomes are dependent on client implementation, organizational culture, and factors outside of Safe4r's control.
10. Indemnification
You agree to indemnify and hold harmless Safe4r Workplace Solutions, Health Karma Inc., and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the services, your violation of these Terms, or your violation of any rights of another party.
11. Termination
Safe4r reserves the right to suspend or terminate access to the platform at any time for violation of these Terms, non-payment of fees, or for any other reason with reasonable notice. Upon termination, your right to use the services ceases immediately.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable federal law and the laws of the state in which the applicable services are provided or in which the Client organization is principally located, without regard to conflict of law provisions. Where the parties cannot determine a single applicable jurisdiction, the federal laws of the United States shall govern.
Safe4r Workplace Solutions operates nationally and serves organizations subject to the laws of all 50 states, U.S. territories, and applicable federal regulatory frameworks including OSHA, HIPAA, and the Occupational Safety and Health Act. Nothing in these Terms limits an organization's obligations under the workplace violence prevention laws of the state or jurisdiction in which they operate.
Any disputes that cannot be resolved informally shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the jurisdiction agreed upon by the parties or, absent such agreement, in the jurisdiction of the Client organization's principal place of business.
13. Changes to Terms
Safe4r reserves the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date at the top of this page. Your continued use of the services following such notice constitutes your acceptance of the modified Terms.
